It is against the law in New Jersey to grow a marijuana plant. If, however, you are arrested for growing 10 or more marijuana plants, you can be charged with a first degree crime of maintaining or operating a controlled dangerous substance facility. The consequences of a conviction for that offense are staggering and include a jail term of up to twenty years where one-half to one-third must be served before you can become parole eligible. Fines can approach $750,000. If you are growing the substance in your home, the government will probably file a civil forfeiture action to seize and sell that home. It is important to know that the statute applies irrespective of whether the plants are mature or mere seedlings.
