Catastrophic Personal Injury Claims

Several kinds of personal injuries are so complicated that getting the full value of your compensation is difficult without the help of an attorney. These serious injuries often lead to life-long debilitation. Examples include brain injury, spinal cord injury, or wrongful death claims. Other personal injury cases, such as recouping medical benefits from a car insurance claim, are often rejected unless presented properly; the assistance of an attorney would give you the best possibility for success.

Traumatic Brain Injury (TBI)
, defined as a blow or jolt to the head or a penetrating head injury that disrupts the function of the brain, can cause extensive debilitation in patients. Unfortunately, the number of injuries caused by TBI is far greater than the annual incidence of many other injuries or diseases, such as breast cancer or spinal cord injuries. According to the Brain Injury Association of America, 1.5 million people will sustain a traumatic brain injury every year. 50,000 die annually as a result of TBI, and 80,000 annually develop long-term disabilities following TBI. 5.3 million Americans currently live with a disability as a result of a TBI.

Spinal cord injuries account for another large percentage of serious personal injuries. According to the Travis Roy Foundation, which is dedicated to spinal cord injury survivors, between 250,000 and 400,000 Americans live with a spinal cord injury, and more than 13,000 are injured annually. The leading causes of spinal cord injuries include vehicle accidents (47.5%), violence (13.8%), falls (22.9%), or sports injuries (8.9%). 42.6% of the spinal cord injury population are affected by paraplegia, which affects the lower body. 56.4% are affected by quadriplegia, which affects both the arms and legs.

The typical costs associated with these injuries are staggering. During the first year following the injury, costs for initial hospitalization, rehabilitation, home modification, and medical equipment amounts to over $244,000 per person. Depending on the level of the injury, it may cost $25,213 per person per year after the initial incident to maintain the health and daily living expenses of patients with these chronic injuries. Putting these costs together on a national level yields an annual bill of approximately $14,533,466,000.

Another significant area of serious personal injury cases involve injuries caused by motor vehicles. Most motor vehicle insurance policies cover medical expenses, but the insurance company does not necessarily advise its clients of the coverage. As a result, many do not pursue making claims for their injuries from their automobile insurance. However, claims can include medical bills, lost wages, and even “pain and suffering.” With that, the claim may go from the typical $2,006 to cover automobile repair and cost of a rental vehicle to a value ranging between $5,741 and $9,871.

But the automobile insurance companies don’t want the average citizen to know about this possibility, nor do they want to make it easy for customers to get the money (although, if presented properly, it’s likely that the insurance company will readily pay the higher value). That’s when the assistance of a good attorney can be of paramount importance.
