If you have been charged with a vehicular homicide, where you were operating a motor vehicle while under the influence of alcohol or drugs, you may be convicted of a first degree crime which is the most serious of all criminal offenses in New Jersey. On the day of sentencing the court can impose a period of incarceration that can range between 10 to 20 years. More over, as a result of New Jersey’s “No Early Release Act,” you will be required to remain in custody for 85% of the actual sentence imposed, and that is so, even though other non-violent offenders can become parole eligible after serving a mere 1/3 of their actual sentence.
