Rape

Experienced and Battle Tested Rape Criminal Defense Lawyer

If you’ve been charged with rape, you undoubtedly already know that you are facing one of the most serious crimes in NJ. If you value your life, freedom, financial stability and your family, you would be wise to take this charge very seriously and immediately seek experienced legal counsel. The last thing you want to do is put your life in the hands of a public defender who will likely be more concerned with negotiating a plea bargain than proving your innocence.

Frank T. Luciano, P.C., is an experienced and proven NJ criminal defense attorney who will fight to keep you out of prison and to preserve your good name. But in order for him to offer you the highest possible level of defense in your rape case, you must contact him immediately. Every day you delay gives an advantage to the prosecution, and when facing this potentially life changing charge, you need every possible advantage on your side.

Simply being accused of rape or sexual assault in Hackensack, Paterson, Jersey City, or any other place in NJ, is enough to damage your reputation forever. A guilty verdict will not only lead to lengthy incarceration, extensive fines and registering as a NJ sexual offender, but it will also follow you around for the rest of your life, making it difficult to find a job, an apartment or to even be with your close family members again. Contact Frank. T. Luciano to ensure this doesn’t happen to you.

Successfully Defending Your New Jersey Rape Case

Sexual assault or rape, according to NJ state law, is defined as “the penetration, no matter how slight, in which physical force or coercion is used or in which the victim is physically or mentally incapacitated.” This law is gender neutral, so it does not distinguish any differences between male or female actors or victims.

In NJ, a person cannot give consent if they are under the age of 16, and they cannot give consent to a person who has “the duty to care” for them (parent, guardian, supervisor, etc) unless they are over the age of 18. In addition, a person who is physically or mentally impaired cannot generally give consent under any circumstance.

In many situations, there is not enough DNA or video evidence to conclusively prove that a victim did not give consent, and often becomes a battle of one person’s word against another’s. This is where the experience and expertise of a battle tested attorney like Frank T. Luciano can make the difference between a guilty or not guilty verdict. Mr. Luciano will challenge the validity of the alleged victim’s story and examine all procedures used by police officers and others handling evidence. At times, missteps in these processes lead to a dismissal of evidence and even a dismissal of the entire rape charge itself.

The Clock is Ticking on Your Freedom

You can rest assured that the prosecution will stop at nothing to achieve a guilty verdict and put you behind bars for several years. You need the protection of an aggressive criminal defense attorney who will fight for your exoneration, rather than settling for the path of least resistance, which most often involves a plea deal. But most importantly, you need to act right now.

If you value your freedom and your life, we urge you to take the first step in preserving them by contacting NJ criminal defense lawyer Frank T. Luciano at 973-471-0004 for an initial consultation. We are eager to begin discussing your legal defense options and the best strategies to achieve a not guilty verdict.

From a former client

"First thing I want to tell is that I thank God for giving me the opportunity to meet such a wonderful person like you and without question, the best lawyer in this world. I am very grateful for everything you did for me. I want to let you know that I'm doing good and if you ever think of coming to . . . for vacation don't forget to contact me. Thanks again Mr. Luciano and please say hello to that kind lady that answers the phone with pleasure every time I called."

From a former client with a First Degree Distribution Charge

"In my distraction focusing on my . . . trial, I failed to ask you how things went with . . . I watched and learned from you throughout that case and greatly admire the consummsate attorney that I hoped to emulate. I witnessed how very hard you worked and how you left no stone unturned. I hope the case worked out for you and your clients. If it did not (and I hope it did) it was not for lack of the effect on your part which was humbling."

From an adversary in a case where we ultimately returned a verdict of $2,069,000

"My family and I would like to thank you for all of your hard work on my case. I feel like I can live my life normally again and it feels awesome. You are truly a professional and wonderful attorney."

From a former client charged with a serious weapons offense

"At the time, I was mortified because, having only worked against you in the Prosecutor’s Office, I couldn’t picture being on the same side. Frank, I want to thank you for the pleasure of having worked with you over the past years. I have learned a great deal from you. Most importantly, I learned that cases were not always as black and white as I thought they were when I worked for the Prosecutor’s Office. You are a wonderful attorney who not only works hard, but also cares deeply about his clients. Frank, I think you are the best."
